A blinking amber light is an emergency light, and can be used for brakes(a loose interpatation), they would have to be used in conjunction with a red stop light(better if solid). I have seen it done and seen guys get away with it. most leos want as much safety as can be had and will agree with the use. if not, you can always put red lenses on them.

Amber lights show up on the rear and don't get washed out.

I put the flashing lights on some extra lights I had on a license plate rack, so I have solid as well as flashing. Flashing amber is legal, here in Ca, many people run their emergency flashers while driving in tule fog. Even though that is not legal, the leos do not stop them as it is a safety issue. You can use flashing amber lights where you think it may be an emergency. Having some come on automatically when braking, might be splitting hairs, but it is safer in the case of a fast stop where you do NOT have time to turn on the flashers.
